摘要 个体经济、私营经济与非公有制经济是民营经济的宪法表述，民营经济宪法规范由核心规范条款与相关规范条款组成。自1982年宪法颁布实施起，由民营经济合法性、财产权、人权规范构成的核心规范与由宪法序言、土地制度、经济体制等构成的相关规范共同成为1982年宪法的民营经济宪法规范。民营经济宪法规范变迁中的宪制脉络主要体现在民营经济进入宪法序言中的时空之维、党的领导与民营经济宪法规范之关联、民营经济国家态度之变迁、从形式国策迈向实质国策的宪法民营经济基本国策与从反思宪法到改革宪法迈向规范宪法的宪法确认功能等五个方面。民营经济宪法规范变迁背后的价值脉络主要体现在百年富强目标与民营经济“合法性”之历史关联、民营经济是解放思想与实质自由的价值载体、民营经济是社会主义内在价值探索的实践产物等三个方面。

Individual economy, private economy and non-public economy are the constitutional expressions of private economy, and the constitutional norms of private economy are composed of core normative clauses and related normative clauses. Since the promulgation and implementation of the 1982 Constitution, the core norms composed of the legality of the private economy, property rights and human rights norms together with the related norms composed of the preamble of the constitution, land system and economic system constitute the constitutional norms of the private economy in the 1982 Constitution.The constitutional system of the private economy is mainly reflected in five aspects: the time and space dimension of private economy entering the preamble of constitution, the relation between“the leadership of the Party”and the constitutional norm of private economy, the change of the attitude of the state of private economy, the basic state policy of private economy in constitution from the form of state policy to the essence of state policy, and the constitutional confirmation function from the reflection of constitution to the reform of constitution to the standardization of constitution. The value context behind the change of the constitutional norms of private economy is mainly reflected in three aspects: the historical relationship between the goal of 100 years of prosperity and the“legitimacy”of private economy, the fact that private economy is the value carrier of the liberation of the mind and the freedom of substance, and the fact that private economy is the practical product of the exploration of the socialist intrinsic value.
